Terms of Service
1. Scope and Applicability.
These Terms of Use (“Agreement”) are applicable to the website, services, content, databases and information (collectively “Services”) provided by Solar Technologies, Inc. (“Solar”) to which you may have access by using the website from which you accessed this Agreement. The content and information included in these Services are provided by Solar and its third party suppliers (collectively “Information Providers”). These Services are made available by Solar subject to the terms and conditions of this Agreement.
2. Agreement.
BY CONTINUING TO USE THE SERVICES, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE, SOLAR IS NOT WILLING TO PROVIDE YOU WITH ACCESS TO THE SERVICES AND YOU SHOULD IMMEDIATELY DISCONTINUE USE OF THE SERVICES.
Solar may modify this Agreement from time to time in its sole discretion and without notice to you. You should review this Agreement periodically to ensure familiarity with its then-current terms and conditions. Your continued use of the Services shall constitute your acceptance of this Agreement, and your continued use of the Services following any modification of this Agreement shall constitute your acceptance of such modifications to this Agreement.
You may also be subject to additional terms and conditions that may apply when you use Services provided by entities other than Solar on the website from which you accessed this Agreement, or when you access any Services provided by Solar from a website other than the one from which you accessed this Agreement.
3. Use of the Services.
The website contains Services that have been obtained from sources believed to be reliable but are not guaranteed as to accuracy or completeness. Product-specific information is based on data made available and/or provided by the respective manufacturers, which are solely responsible for its content and accuracy. Solar shall not be responsible for typographical or other errors or omissions regarding any information or Services provided. The Services (and the content and information included therein) are protected by copyright pursuant to United States laws and international treaties and are owned or licensed by Solar or the Information Provider(s) credited. You shall abide by all copyright notices, information, or restrictions contained in any content or information accessed through the Services.
These Services are provided for your personal, non-commercial use only. 4. Intellectual Property.
All trademarks, service marks, logos, slogans, domain names and trade names (collectively “Marks”) are the properties of their respective owners. Solar disclaims any proprietary interest in Marks other than its own.
The copyright in all original material provided on this website is held by Solar, or by the original creator of the material. Except as provided herein, none of the Services may be reproduced, retransmitted, disseminated, sold, distributed, performed, displayed, published, broadcasted, circulated, downloaded, or copied in any form or by any means, without the prior express written permission of Solar and/or the copyright owner.
If you believe that your work has been copied or used in a way that constitutes copyright infringement on Solar’s website, please provide notice to Solar’s Copyright Agent and include the written information specified below. Please note that this procedure is exclusively for notifying Solar of the allegation that your copyrighted material has been infringed.
• An electronic or physical signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
• A description of the copyrighted work that you claim has been infringed upon;
• A description where the material that you claim is infringing is located on this website;

5. Termination.
Any permission granted herein terminates automatically without further notice if you breach any of the terms and conditions contained herein. Upon such termination, you agree to immediately destroy any downloaded or printed materials. Any unauthorized use of any material contained on this website may violate domestic or international copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. Solar may discontinue or change the Services or their availability to you, immediately, in its sole discretion, at any time without cause. Solar may terminate this Agreement and your access to and use of the Services, or any portion thereof, immediately, in its sole discretion, at any time without cause. You agree that the terms and conditions of this Agreement shall survive any termination of your right of access to the Services.
6. Disclaimer of Warranties.
Solar and the Information Providers furnish the information available in connection with these Services without responsibility for accuracy and you agree that errors or omissions contained in such information shall not be made the basis for any claim, demand or cause of action against Solar or any Information Providers. Solar believes the Services (including the information and content therein) to be reliable, but accuracy is not warranted or guaranteed. Solar may point to other websites that may be of interest to you but for which Solar has no responsibility. The Services includes facts, views, opinions and recommendations of individuals and organizations deemed of interest. Neither Solar nor the Information Providers guarantee the accuracy, completeness or timeliness of, or otherwise endorse these views, opinions or recommendations, give any advice, or advocate any particular product, good or service.
You understand and agree that your use of the Services is at your sole risk. THE SERVICES ARE PROVIDED ON AN “AS-IS” BASIS. SOLAR AND THE INFORMATION PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
7. Limitation of Liability.
NEITHER SOLAR NOR ANY OF ITS INFORMATION PROVIDERS, PARENTS, MEMBERS, SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE DAMAGES, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Miscellaneous.
This Agreement constitutes the entire, final and exclusive agreement between you and Solar regarding your use of the Services on the website from which you accessed this Agreement. The provisions of this Agreement supersede all prior and contemporaneous oral and written communications, agreements, and understandings between you and Solar with respect to the subject matter of this Agreement. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.
You agree this Agreement and any claims arising from it shall be construed, interpreted and enforced under and in accordance with the laws of the State of California, without regard to its conflicts or choice of law rules or principles. Any arbitration, enforcement of an arbitration or litigation shall be exclusively submitted to the jurisdiction of the State of California, County of Orange, or the United States District Court at Santa Ana, California. You agree and consent and submit to the jurisdiction expressed herein, and waive any rights to change venue.

Privacy
1. Scope and Applicability.
This Privacy Policy only applies with respect to information Solar Technologies, Inc. (“Solar”) collects from websites on which a direct hyperlink to this “Privacy Policy” is posted. It describes the way Solar handles information learned about you from your visit to our website. Other websites (including those we link to) not owned or operated by or for Solar have different data processing practices for which Solar does not vouch or assume responsibility.
2. Collection of Information.
Solar may collect statistical information about you, such as the pages visited on the Solar websites, unique URLs visited within our websites, the domains from which people visit our websites, browser type and IP address. Generally, Solar does not link such information to any of your contact information (such as name, email address or user name). Most of this information would be collected via cookies or other analysis technologies. Accepting the cookies does not grant Solar access to your personal information, but Solar may use the cookies to identify your computer. Solar may also collect personally identifiable information about you that you voluntarily submit, such as by submitting a request or inquiry for products or services on our websites, filling out a form or survey, registering your email address with Solar or emailing us. Solar may also collect personal information from you at other points on our websites that state that personal information is being collected. Personally identifiable information that Solar collects from you may consist of your contact information, product purchase information or product usage information.
Solar is committed to protecting the privacy needs of children, and Solar encourages parents and guardians to take an active role in their children’s online activities and interests. We do not knowingly collect personal information from children and we do not knowingly market our products or services to children.
3. Disclosure.
Solar does not sell or rent your personally identifiable information to any third parties, unless otherwise provided in this Privacy Policy or required by law. Solar may share your personally identifiable information and aggregated (non-personally identifiable) information with our affiliates if lawfully allowed to do so. The affiliated companies may be in the United States or in other parts of the world. If required under applicable laws, whenever you submit personal information to Solar during your visit to our websites, Solar shall provide a method for you to (a) prevent the use of this information for marketing purposes or, (b) prevent the disclosure of this information to third parties for marketing purposes, if you so choose.
Solar may disclose your information when responding to subpoenas, court orders, government inquiries or legal processes, when establishing or exercising its legal rights or defending against legal claims, when performing contracts with you or in other circumstances permitted or required under applicable law.

Solar could merge with or be acquired by another business entity or some or all of our assets could be acquired. If such a combination or acquisition occurs, Solar shall notify you by posting a prominent notice on our website in the event Solar shares with the merging or acquiring entity some or all of your personal information.
4. Use of Information.
Solar may use personally identifiable and non-personally identifiable information for our marketing and sales purposes, for website administration, and for such purposes as expressly stated when you provided your information. Solar shall not use this information for other purposes, unless you consent to the new usage or if required or permitted by applicable law. When applicable, Solar shall use personally identifiable information to perform the services for which such data was collected. (For instance, if you order a product or service, Solar shall deliver the product or provide the service as requested or if you sign up for an email newsletter, Solar shall send the email newsletter to the address you provide us).
If you want to opt-out of receiving communications you have expressly requested (such as e-mail newsletters), you may do so by selecting the “opt-out” or “unsubscribe” link in each email that you receive from Solar or by returning to the website where you originally submitted your information, if applicable, and following the opt-out instructions therein.
Solar may send you e-mail communications with information, which may be useful to you, including information about available products and services. When you first provide Solar with your e-mail address, you will be given the option of not receiving any such e-mail communications. Solar shall include instructions in e-mail messages on how to unsubscribe if you later decide you do not want to receive any future e-mail communications.
